Well, what is actually behind the new rules remains to be seen in the future. At the moment we can only guess and wait.
Liberty Reserve has recently introduced an anti-money laundering policy which was accepted by some users as a potential threat to their funds and subsequent devaluation of the services offered by the payment processor and as a result liquidity diminution.
The new policy says:
LIBERTY RESERVE S.A. views Money Laundering as a serious criminal offence, and as such, complies with regulatory requirements intended to forestall and prevent money laundering. These include:
· Verifying the identity of our Exchangers, in addition requesting from them a compromise to verify the identity of their direct clients. The identity of any direct client of LIBERTY RESERVE S.A. will be verified according to the Costa Rican laws.
· Retaining transaction and identification records for a minimum period of five years.
· Training staff continuously in terms of anti-money laundering regulations.
· Appointing compliance officer responsible for monitoring and reporting any and all suspicious activities.
· Supervise and oversea that all transactions and information in the system is correct and complies with Law No. 8204 and applicable laws.
Correspondingly Liberty Reserve payment processor has introduced some amendments into its Terms of Use:
12.2. Issuer may at any time restrict or terminate an Account without notice in case: (i) you breach any condition of these Terms of Use or any other condition applicable to specific services covered by separate terms and conditions; (ii) violate any applicable law or regulation, (iii) Issuer suspects User receipt of potentially fraudulent funds; (iv) Issuer must comply with money laundering investigations conducted by competent government authorities agencies or commissions; or (v) Issuer must comply with other investigations conducted by competent government authorities, agencies or commissions;
These facts made some users to make such a conclusion: “LR accounts will be blocked by a chain as Paypal, E-gold etc...”
One user said in a posting at the popular money forum: “I'm just warn you 10-15 days, and LR will be like e-gold. History repeats.... Providing LIBERTY RESERVE S.A. with false identification or contact details will be deem as a misuse of our terms of service. LIBERTY RESERVE S.A. is legally bound to report such misdemeanors to the Costa Rican authorities, and as such you may be the subject to a criminal investigation.”
